TOYASIDO TERMS OF USE (TTOU)



This website toyasido.com is owned and operated by WWKK, a company in Tokyo, Japan.

These Terms and Conditions shall apply to all users of the domain toyasido.com (henceforth: the site), including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.These Terms and Conditions will be valid for all your future transactions with WWKK (henceforth: TOYASIDO; may be referred to as “we”, “us” and “our”) and visits to the site.

Please read these Terms and Conditions carefully before using toyasido.com. By visiting or using any part of the site, you agree to be bound by these Terms and Conditions, policies and notices stated or referenced herein and/or available by hyperlink.

Any new tools or features which are added to the current site shall be subject to the Terms of Service. WWKK reserves the right to revise these terms and conditions from time to time. The date of the latest update is found in the final section of the Terms and Conditions. Users are responsible for keeping themselves updated with such changes. You should keep a copy of these Terms and Conditions for future reference.


ORDERS

By using toyasido.com and/or placing an order on the site you confirm that you have read our Terms and Conditions and that you accept them. Please make sure that you have read and understood the Terms and Conditions before you place an order. You agree to provide current, complete and accurate purchase and account information for all orders made on the site.

You may follow the various prompts on screen to add product(s) to your cart. Before you purchase an order, you will be given the opportunity to review your selections, the information you have provided, the total price of your order and correct any input errors. You may proceed to submit your order to us by clicking the “CHECK OUT” button. Please note that product(s) in your cart are not reserved and may be purchased by other customers until you have placed the order at checkout and received the order confirmation email.


ORDER CONFIRMATION

After placing an order with us, an order confirmation is sent to the email address you registered in the checkout. The email confirming your order contains your order number, details of the product(s) that you ordered from us, your payment details and delivery details. Please note that the confirmation email is only an acknowledgement that we have received your order, is not an acceptance of the order.

We reserve the right to limit the quantities of TOYASIDO products that we supply, and/or to refuse any order that is unusual or placed in bad faith. In addition, we reserve the right to refuse any order from a customer with whom there is a dispute concerning the payment. All orders placed by you are subject to acceptance by us. We may, at our discretion, choose not to accept your order for any reason whatsoever without any liability to you. We do not warrant that the quality of any products, services, or other material purchased or obtained by you will meet your expectations.


AVAILABILITY

We does not guarantee that all items included in toyasido.com are in stock or are available for purchase at the time of your order. In the event that an item is unavailable, we will contact you by email or by phone as soon as possible. We will refund you the amount of the purchase if we already have received payment from you.


COLORS

We cannot guarantee that colors on the site will be true to life. This depends partly on the color settings of your computer, phone and browser.


PRICES

All prices on the site are stated including applicable Japanese consumption tax but excluding shipping charges. Shipping charges for your order (if any) will be calculated and displayed at the checkout section. Final payment will be made in Japanese Yen.

Prices for our products are subject to change without notice. We also retain the right to adjust incorrect prices. If you have been charged the wrong amount, We will give you the option of placing a new order with the correct price or canceling your order. We, however, reserve the right to cancel any order prior to dispatch should we find that the price is incorrect. In such case we will notify you by email.


PAYMENT

We accept most major credit/debit cards. The full payment is charged when the package is dispatched. All transactions are 100% secure and encrypted. You should be aware that all online transactions and all credit/debit cardholders are subject to validation checks and authorization by the card issuer. We will not be liable for any delay or non-delivery if the issuer of your payment card refuses to authorise payment to us for any reason.

We also offer Paypal as a paying method. PayPal allows secure payment with your PayPal account or credit/debit card. You will be redirected to PayPal to finalize your order when checking out. When paying with PayPal, your shipping address needs to be your registered residence. Please visit www.paypal.com for additional information.

Alternatively, you can order by email. Please email us with product details (product name, color, size, product URL) and shipping information (name, address, phone number). We will contact you shortly regarding the total amount with PayPal invoice. You may also pay in advance. Advance payment can be for reserved products and special items. We may send you an order confirmation with details in.


SHIPPING

As soon as TOYASIDO has received a receipt of your transaction we will process the order. We aim to process and dispatch your purchased items in the shortest time possible. During new releases or sales period, processing of your orders may take longer time than usual. We operate everyday with the exception of Japanese public holidays.

Orders within Japan will be shipped with Sagawa Express. International orders will be shipped with EMS (Express Mail Service) by Japan Post. Please find more information about shipping on toyasido.com/pages/shipping.

Once your order has been shipped from our warehouse, a shipping confirmation will be sent with all relevant information about your order. You will receive the tracking number in the e-mail and your parcel can then be tracked on the carriers’ tracking pages (EMS, SAGAWA).

Some countries are not available now by EMS (JAPAN POST), so if you can not find your country or region in the checkout page, please email us. Also please check the updates here.


DELIVERY

Please ensure the delivery address specified by you on the order form is accurate. A physical street address and signature upon delivery are required. Valid identification must be shown when collecting the package.

Some countries may charge additional duties and taxes to customers on delivery of an international package, this has nothing to do with TOYASIDO. Any additional costs for customs clearance are the responsibility of the customer. This may delay your delivery time as goods held at customs will be your responsibility to pay the necessary charges for local authorities to release the packages. Please observe and comply with all the applicable regulations.

TOYASIDO reserves the right to charge you the actual cost for any shipping cost for uncollected packages. The shipping charges will be deducted from the amount paid for the order.


CANCELLATION AND RETURNS

Please note that we don’t accept any cancellation and returns.

AGE

Please note that orders can only be placed by private individuals above the age of 18 at the time of the placement of the order. If you are under 18, you may only use this site, or any of this site’s services, with the agreement of, and under the supervision of, a parent or guardian.

Downloads and prints of this site are only allowed for private and non­commercial use. You may not charge anyone for use of the material and you may not duplicate, edit, reproduce, publish, or otherwise transmit and distribute the material to others without our written permission. Except as expressly indicated, no rights or licenses to the material, or any portion thereof, shall be granted or implied. Unauthorized utilization of copyrighted works is punishable.


TRADEMARKS

Our trademarks include, but are not limited to, the TOYASIDO name and logos and the WWKK name and logos. Your use of this site does not grant you any rights to use our trademarks.


SECURITY

We take appropriate care to make our site as secure as possible, to keep the details of your order and payment secure. You are solely responsible for your login information on toyasido.com. We use Secure Socket Layers (SSL), the industry standard in transferring information to process your orders that secures communications by encrypting all data to and from the site. For security reasons, we do not store any payment information in our database.


PRIVACY POLICY

All personal information saved at the site will be handled with the most utmost care. The information that we store will not be sold or used for any purposes other than ensuring the best service possible. It will be solely used for fufilling the order and informing you about special offers and other marketing opportunities. In case of Force Majeure, TOYASIDO obligations will be suspended. The contract between you and TOYASIDO can, in such cases, be partially or fully terminated by yourself or by TOYASIDO. A Force Majeure is, but not limited to, in the event of acts of God, acts of government or governmental authorities, war, civil war, revolution, riot, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events. Under such circumstances, TOYASIDO will attempt to resolve all issues in a timely manner.


GOVERNING LAW

This site, these Terms and Conditions, and any seperate agreement or memo, entered into as a result of use of this site are governed in accordance with Japanese Law and the district court of Tokyo will have exclusive jurisdiction for any dispute under these related agreements. 


LANGUAGE

The languages of the Terms and Conditions are English and Japanese.
